1. Who is the data controller?

In this Privacy Policy , "CubeSoft" refers to CubeSoft Communications Inc. CubeSoft is the data controller as it processes your data on its own behalf. The contact details of the data controller are:

2. What data is collected?

As a user, when you browse the Web sites and/or use the services offered by CubeSoft on the Web sites, CubeSoft may collect the following personal data about you:
- Identification data: name, date of birth, IP address and its location, user ID;
- Contact data: postal and e-mail address, telephone number;
- Data relative to the method of payment or otherwise connected with your payments (e.g., details of credit card);
- Data related to the interactions between the customer and CubeSoft: cookies, hidden pixels, customer experience, payment methods used, e-mail exchanges;
- Data relative to the processing of e-mails and communications sent to you, such as timestamp and date.

Regardless of the method of collection, CubeSoft undertakes to inform its users of:
- The purpose of the processing carried out;
- The compulsory or optional nature of the information requested and the possible consequences of a lack of response;
- The recipients of the data;
- The existence and the methods for exercising their rights (including in particular the rights of access, rectification, and opposition to the processing of their personal data).

3. What use is made of the data collected?

The personal data CubeSoft collects from you is required to enter into a contract with CubeSoft, for CubeSoft to perform under the contract, and to provide you with our products and services and the information you request. If you refuse to provide such personal data or withdraw your consent to our processing of your personal data (when appropriate), then we may not be able to enter into the contract or fulfill our obligations to you under it.

We will use your e-mail address to respond to your support inquiries and to send you notifications related to your use of the Hosting service. If you use our Hosting service, we will use your e-mail address to send you notifications about recurring payments and to let you know when new invoices are available. We may contact you by e-mail if we find potential security problems with your hosting account that require your attention. We may contact you by e-mail to notify you about server maintenance, software updates and any other other information relevant to the Hosting service.

E-mail exchanges between you and our technical support and sales department staff are archived and stored for a period of up to 1 year. You can request that this correspondence be deleted before this period by sending a request by e-mail to privacyofficer@csoft.net, or in writing at the address in section 6.

Generally, we use the information you provide about yourself when you subscribe (or subsequently update your profile) for processing recurring payments and for contacting you regarding issues specific to subscription to our Hosting service. We will not share this information with any third parties.

4. Our commitment to data security

We have put in place appropriate physical, electronic, and managerial procedures to safeguard and secure the information we collect online.

PA-DSS

We conduct regular vulnerability scans and penetration tests in accordance with the PCI DSS requirements for our business model. We attest to our PCI compliance annually, and our most recent self-attestation was completed in September, 2023.

We maintain multiple backup copies of all user files, including private files. Backup copies remain physically in our server cabinets. The data center we use (365 Data Centers) is secure and guarded 24/7. We never ship any media containing private user data or personal information, such media is kept locked in our cabinet at all times.

We will not read or modify the content of data files uploaded or otherwise generated by you on our servers, unless you provide us written permission to do so. Copies of all your files are produced for backup purposes, so this policy also applies to all backup copies of your files. CubeSoft administrators will not access the content of your files, but they may access to the following information about them:
- The file name;
- The file size;
- The date and time of the most recent modification.

Although we will not read the contents of your private files, we encourage you to encrypt and and digitally sign any sensitive information you wish to place on our servers. This is simple to do using tools such as gpg(1) and S/MIME for e-mails. We understand that the security of the private files you place on our servers is dependent on the security of parts of the server software that we use. We consider the prevention and prompt addressing of potential security vulnerabilities in server software to be an essential part of the service that we provide, and we work diligently to keep our server software free of security vulnerabilities.

5. Use of Cookies

For subscribed users of our Hosting service, our Control Panel uses Cookies to facilitate the login process for authenticated users. We do not use Cookies to track how anonymous visitors use our web site.

6. Your rights

You have the following rights with regard to the processing of your personal data:
- To request access to your personal data;
- To obtain the rectification of inaccurate data;
- In certain specific cases, obtain the deletion of some of your data;
- In certain specific cases, obtain the limitation of the processing that CubeSoft carries out;
- To object to the processing of your data on grounds relating to your particular situation or, regardless of your particular situation, to the use of your data for canvassing purposes;
- To receive the data you have provided and/or to request that it be passed on to another data controller;
- If you reside in Canada, to determine the status of your data after your passing away.

7. Updates to our policy

We may use customer information for new, unanticipated uses not previously disclosed in this Privacy Policy. If our information practice changes in the future, we will post the policy changes on this page to notify you of these changes and provide you with the ability to opt-out of any new use of your personal data.
